MEANS OF OBTAINING AND COLLECTING OF PERSONAL DATA.\n\nNEST collects the following personal data necessary and applicable to comply with the purposes of this Privacy Notice, depending on the relationship that exists with the client,\n\nPersonal data collected in a personal manner:\n\nPersonal identification data, financial data, third party data (When providing personal data of third parties, it is understood that the consent of the owner of personal data has been given).\n\nPersonal data collected directly through web page, email and telephone.\n\nPersonal identification data, financial data, third party data (When providing personal data of third parties, it is understood that the consent of the owner of personal data has been given).\n\nPersonal data collected indirectly through third-party transfers and public access sources that are permitted by law.\n\nPersonal identification data.\n\nThe client is informed that the images and sounds captured through the video surveillance system will be used for client safety and that of those who visit. When participating in events and reports, the client is informed that the captured images and sounds may be disseminated through internal communication media and the different social networks. Also, the sounds collected through the different media used, will be treated as a support to monitor the quality of our services.\n\nIII. PURPOSE\n\nMore than a policy, in NEST has the philosophy of maintaining a close and active relationship with clients and potential clients. In terms of the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals (the Law) and its Regulations, the personal data provided to us will be used for the following purposes:\n\nNecessary for the provision of the service:\n\ni. To perform the tasks, and procedures for the acquisition of goods, products and/or services for our clients and potential clients.\n\nii. To provide the client with lodging services, which include restaurants (food and drinks); bars and entertainment, recreational activities; boutique, spa services.\n\niii. To provide customer programs and diverse recreational, cultural, entertainment and health activities.\n\niv. To provide customer Concierge services and medical service (external provider, available 24 hours a day, independent service with charges for consultation).\n\nv. To complete guest registration and allow charges to credit and/or debit cards.\n\nvi. To make reservations according to the specifications and needs of the guest; as well as to make changes to reservations or cancel services.\n\nvii. Obtain data from your credit card, which will only be used to collect the services requested by the client and as a reservation guarantee, issuing a charge only in the case of not complying with the reservation cancelation policy.\n\nviii. To provide event services (events, banquets), tourism and commercial services requested by the client.\n\nix. To comply with the contractual obligations that have been entered into pursuant to the existing commercial relationship.\n\nx. To process requests, carry out collection, billing and clarification activities.\n\nxi. To keep our records updated to answer your questions.\n\nxii. To comply with the laws, regulations and other applicable legal provisions.\n\nNot necessary for the provision of the service:\n\n1. To carry out marketing, advertising and commercial research activities, of different goods, products and services offered by NEST.\n\n2. To carry out internal studies on consumer habits, marketing, advertising and commercial research related to goods, products and services offered by NEST.\n\n3. To follow up on the commercial relationship and request the evaluation and follow-up to determine the level of satisfaction of our goods, products and services.\n\nIt is important to mention that purposes (i), (ii), (iii), (iv), (v), (vi), (vii), (viii), (ix), (x), (xi) and (xii) originate and are necessary.\n\nPurposes (1), (2) and (3) are not necessary, but are important to offer clients, through campaigns of marketing, advertising and commercial prospection, goods, products and exclusive services, for which they have the right to object, or, to revoke their consent for NEST to stop processing personal data for such purposes, in accordance with the procedure indicated in section IV or V of this Privacy Notice.\n\nIt is hereby acknowledged that the client has a period of 5 working days to express refusal regarding the processing of personal identification data, in relation to the purposes of subsection (b) of this section, in accordance with the mechanism established in section IV. of this Privacy notice.\n\nIV. OPTIONS TO LIMIT THE USE OR DISCLOSURE OF YOUR PERSONAL DATA.\n\nNEST communicates that, if a client wishes to stop receiving messages of marketing, advertising or commercial prospecting, related to the purposes referred to in subsection (a) of section III, it can be made valid through an email to concierge@nestloscabos.com, as well same, in this manner doubts and comments about the treatment of personal data will be attended to.\n\nV. APPLICATION FOR ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION OF PERSONAL DATA (ARCO RIGHTS) AND REVOCATION OF CONSENT.\n\nAll personal data are treated according to the applicable legislation and in force in the country, so we inform our clients that they have the right to access, rectify, cancel, or oppose the treatment given to personal data at all times, as well how to revoke the consent granted for their treatment; rights that may be asserted through the Reception Manager, the person designated by NEST for this purpose, or by sending an email to concierge@nestloscabos.com, to be provided with the ARCO Rights Application Form, which must be filed at the address of the Responsible Party, with a copy of official identification to prove ownership. The response to requests for ARCO Rights will be sent to the email address provided within 20 working days from the reception of said request. Likewise, the right of access will be deemed fulfilled when the corresponding response is sent to the email address indicated for this purpose.\n\nThe exercise of the ARCO Rights will be free, in its case, the owner must cover the costs of sending, reproducing and/or certifying documents; However, if the holder exercises the same right in a period no longer than 12 months, the response to the request will have a cost that will not exceed 3 days of the general minimum wage in force in the Federal District.\n\nIf the client does not agree with the processing of his/her personal data, (s)he can go to the INAI.\n\nVI. TRANSFERS OF PERSONAL DATA.\n\nTransfers without consent:\n\nThe client is informed that in order to comply with the purposes set forth in subsection (a), section IV of this Privacy Notice, personal data may be transferred and processed inside and outside the United States of Mexico by persons other than NEST. In this sense and based on the Law and its Regulations, personal data may be transferred without consent to: (i) Third party service providers, solely and exclusively for the fulfillment of the purposes established in subsection (a) of section III of this Privacy Notice; (ii) To third party service providers for the provision of services for social, tourist and commercial events; (iii) Authorities, emergency services, and (iv) To third parties to carry out extrajudicial and judicial collections in case of non-compliance.\n\nTransfers with consent:\n\nNEST may transfer personal identification data to marketing and advertising companies for the purposes described in subsection (b) of section III of this Privacy Notice and other companies in the tourism sector, goods, products and services with which there is any relationship commercial and/or business with the purpose of granting benefits when acquiring them. If a client does not want personal data to be transferred to said third parties, the refusal can be expressed according to the procedure established in section IV of this Privacy Notice.\n\nVII. USE OF COOKIES:\n\nNEST informs you that it will use “cookies and web beacons” to obtain personal information from you automatically. MODIFICATIONS TO THE PRIVACY NOTICE.\n\nThis Privacy Notice may be modified from time to time in NEST, such modifications may be consulted through the following means:\nOur website www.nestloscabos.com (Privacy Notice Section).\nVisible notices in our NEST facilities.\nAny other means of oral, printed or electronic communication that NEST determines for that purpose.","terms_text":"TERMS\n\nHOTEL POLICIES\n\nGENERAL\n\nNEST Los Cabos (from here named as the “Hotel”) is a property operated by NU TULUM S.A. de C.V.\n\nThe general terms and conditions herein together with the privacy policy, bookings & cancellations policy, fee schedule & hotel schedule, and add-ons available on the hotel website and the booking confirmation issued by the hotel confirming your booking (“booking confirmation”) shall constitute a legally binding contract between you and the hotel and shall be further supplemented by the internal rules and regulations that apply specifically to the hotel where you have booked your stay.\n\nIn these terms and conditions, the words “we” or “us” means hotel and its employees, officers, agents, suppliers, and vendors, and use of the words “you” or “guest(s)/guest(s)” means any and all persons for whom a hotel room is booked.\n\nThe guest(s) hereby confirms that he is the owner of the registered credit card(s) left as a guarantee in their reservation and authorize us to charge all the costs of rooms, additional services, consumption, food & beverage, damages, incidentals, deposits and penalties related to their reservation(s) before, during and after your stay.\n\nDEPOSIT POLICY\n\nDepending on the selected rate during the booking process, a deposit fee will be collected according to the conditions indicated in their policies.\n\nBy completing this booking request, you certify that you are the cardholder and authorize us to charge your credit card automatically with the amount due at that time. The available payment options are displayed during the booking process on our hotel website. Payment by check is not accepted.\n\nOnce your booking has been successfully completed, a booking confirmation will be issued with reference to each room booked and sent to the email address provided in your booking reservation. You must produce your booking confirmation(s) upon check-in at the hotel, together with your original valid photo identification document (national registration identity card, passport, driver’s license, or other identification card or document as the hotel may require).\n\nIf you do not receive your booking confirmation(s) within twenty-four (24) hours from the time of booking, please contact us via the hotel website, by phone, or by email. The ‘guest’ named in the booking confirmation must be the person staying at the hotel otherwise we reserve the right to cancel the booking.\n\nAt all times during the booking process, you will be advised to ensure the accuracy of your booking details (guest details, stay dates, room types, room rates, number of guest(s), add-ons). The hotel will not be responsible or liable for errors in booking details. Bookings are accepted subject to room availability.\n\nThe only valid booking sources are the links provided on our active website www.nestloscabos.com and our official OTA profiles (please verify first with our Reservations Department at reservations@nestloscabos.com). Any other booking source is invalid and the hotel will keep the right to refuse any reservation coming from these sites. Also, the hotel will not be responsible for any damage caused by a booking created by these unauthorized sources.\n\nGROUP BOOKINGS\n\nGroup Booking Policy: Our standard reservation and cancellation policy is applicable for bookings of up to 4 rooms. However, if a single group reserves more than 4 rooms, our group policies will be enforced. These policies protect our business from potential cancellations and ensure an optimal experience for our guests. Non-compliance with the group reservation terms may result in reservation cancellation. A reservation of 13 rooms is considered a buyout and requires a special contract. Separate rates and policies apply to buyouts, and they are exempt from the following policies.\n\nGroup Deposit Policy: For group bookings of 5 to 6 rooms, a deposit equal to the total amount of the reservation will be collected 30 days prior to the arrival date. For group bookings of 7 to 9 rooms, a deposit equal to the total amount of the reservation will be collected 60 days prior to the arrival date. For reservations of 10 to 12 rooms, a 50% deposit is required, with the remaining balance due 30 days before the arrival date.\n\nGroup Cancellation Policy: Cancellations for group bookings of 5 to 6 rooms are allowed free of charge if requested before 30 days from the arrival date. Cancellations made 30 days or less before arrival will incur a charge of 100% of the reservation amount. Cancellations for group bookings of 7 to 9 rooms are allowed free of charge if requested before 60 days from the arrival date. Cancellations made 60 days or less before arrival will incur a charge of 100% of the reservation amount. For group bookings of 10 to 12 rooms, cancellations made between the booking date and before 30 days prior to arrival will incur a 50% cancellation fee. Cancellations made 30 days or less prior to arrival will be subject to a 100% cancellation fee for the entire reservation amount.\n\nNON-REFUNDABLE RATES\n\nDo not allow for changes or cancellations at any time. The total cost for all room nights including taxes (16% VAT and 5% hospitality taxes) will be charged directly after your reservation is made.\n\nPACKAGES\n\nAll bookings and promotions made for packages are non-refundable. The full amount is billed at the time of booking on your credit card.\n\nROOM RATES\n\nRoom rates shown on the hotel website are charged on a per room per night basis. Meals and add-ons are not included. Room rates do not include service tax, service charge, VAT, or other similar charges or taxes subject to the requirements of the country or location where the hotel is located. These will be charged in USD, independently then where the hotel is located.\n\nRESTRICTIONS\n\nWe strictly enforce a no-smoking policy throughout all designated hotel guest rooms, (including private patios and balconies) as well as public spaces.\n\nA $200 USD deep cleaning fee will apply to any guest for smoking in rooms or on patios/balconies that are designated non-smoking. Additionally, failure to comply with this policy entitles us to terminate your booking and stay at the hotel at our sole discretion, and you must leave the hotel immediately without compensation or reimbursement.\n\nYou shall be liable for any costs, loss, or damage incurred by the hotel, including without limitation any loss or damage to the hotel room, premises, or property or incurred by hotel guests or third parties, arising from your failure to comply with this policy. The hotel also reserves the right to charge you for any such costs, loss, or damage incurred by the hotel or any hotel guests or third party.\n\nYou may not bring the following into our hotel:\nPillows, bed sheets, duvets, or other items of bedding.\nAny electrical appliances and/or equipment for heating and/or cooking purposes.\n\nThe hotel reserves the right to remove and/or confiscate any of the above items found in any hotel room immediately without notice to you and to charge you for any costs incurred for taking such action or for any loss or damage caused to the hotel room, premises or property or to any hotel guests or third party as a result of your failure to comply with this policy.\n\nThe hotel further reserves the right to ask you to leave the hotel and remove your belongings from the room immediately if we shall, in our sole opinion, deem that you have used the hotel room in an irresponsible manner or in a manner that will compromise the safety of, or cause damage and/or harm to the hotel room, the hotel premises, the other hotel guests, our staff or any other persons or the reputation of the hotel, without any compensation and/or any reimbursement to you.\n\nCHILDREN\n\nDue to our small size and intimate atmosphere, we only allow children aged 13 and older in the hotel.\n\nPETS \n\nWe love pets almost as much as we love kids, but unfortunately, pets have to stay at home during your visit to NEST Los Cabos.\n\nHOTEL DRONE POLICY\n\nOperation and use of drones, radio controlled aircraft, or unmanned aerial systems (“Drones”) are prohibited within the boundaries of the Resort, unless conducted for authorized events. Unauthorized operators may not operate Drones for take-off or landing from Resort property, and may not fly Drones over the immediate airspace above the Resort. This prohibition is intended to apply to general commercial filming as well as any recreational users or hobbyists.\n\nSpecial events at the property may utilize drones to film during authorized event activities provided the filming location and hours correspond to the special event. Drone operators must comply at all times with the regulations under the Federal Aviation Administration, and state and local laws for Drone operations.\n\nThe Hotel respects and honors the safety and privacy of all guests and staff. Violators are liable for any damages, including but not limited to physical personal injury, property damage, damages for violation of privacy, regulatory fines and legal fees.\n\nCHECK-IN AND CHECK-OUT\n\nOur hotel operates a strict check-in and check-out policy. Minimum age for check-in: Guests must be 18 years or older with a valid photo ID to check-in.\n\nID requirement: The hotel will accept any government-issued photo ID at the time of check-in, such as a passport or valid driver’s license, with a corresponding credit card.\n\nThe Credit Card used to purchase the room will have to be produced at the time of check-in. We highly recommend to purchase a travel insurance for any inconvenience or emergency that could prevent visiting us as planned.\nIf you booked on a website other than the hotel’s and need to make a change to your reservation please go through the booking agent/website that you made the initial reservation with to request changes.\nA credit card fee of 10% will be retained from any refund.
